01General Terms

About These Terms

These Terms & Conditions (“Terms”) govern your access to and use of the public websites operated by RAW Recovery LLC (“RAW,” “we,” “us,” or “our”): rawrecoveryandwellness.com, emotionalfortitude.com, and fortitudeprogram.com (together, the “Sites”). The same Terms apply to all three Sites.

Our members-only client portal at clients.emotionalfortitude.com and the RAW app, and enrollment in The Fortitude Program™ and other RAW programs, are governed by the separate Member Portal Terms & Conditions and any program agreement you sign. If those documents conflict with these Terms, the more specific document controls.

Acceptance of Terms

By using the Sites, booking a call, taking an assessment, or submitting an application, you agree to these Terms. If you do not agree, please do not use the Sites.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. If you keep using the Sites after an update is posted, you accept the updated Terms.

Eligibility

The Sites and our programs are for adults. You must be at least 18 years old to book a call, take an assessment, apply to a program, or sign up for our emails.

02Important Disclaimers

Please read this section carefully. It explains what RAW is and is not.

Not Therapy or a Mental Health Service

RAW Recovery LLC provides recovery coaching, performance coaching, and educational training. RAW is not a licensed mental health agency, clinical treatment facility, or medical provider. Nothing on the Sites, including articles, videos, assessments, frameworks, glossaries, or any communication from a RAW coach, is psychotherapy, clinical counseling, psychiatric treatment, medical advice, or any other licensed professional service regulated under California Business and Professions Code §2903 or any similar law.

Educational Content Only

Content on the Sites is offered for general education and reflection. It is not tailored to your circumstances and should not replace advice from a qualified professional who knows your situation.

Assessment Results

Our online assessments are self-reflection tools. Results are not a diagnosis, clinical evaluation, or prediction of outcomes.

No Guarantee of Outcomes

Recovery and personal development vary widely from person to person, and your outcomes depend on many factors outside RAW’s control, including your history, effort, consistency, and circumstances. RAW makes no warranty, express or implied, that any program, call, or content will produce a particular result.

Stage of Recovery

RAW programs are designed for men in a stable phase of recovery who are committed to growth-oriented work. They are not designed as primary treatment for active addiction or acute withdrawal. If you are in the early, unstable stages of recovery, we strongly encourage you to engage with clinical treatment first.

03Using the Sites

You may use the Sites for your own personal, non-commercial purposes. You agree not to:

• Use the Sites in any way that breaks the law or infringes anyone’s rights;
• Submit false information, or book calls, take assessments, or apply on behalf of someone else without their permission;
• Try to gain unauthorized access to the Sites, our systems, or the member portal;
• Interfere with the Sites’ security or operation, including by uploading malicious code or overloading our servers;
• Scrape, harvest, or copy content or data from the Sites by automated means; or
• Use the Sites to send spam or unsolicited promotions.

We may change, suspend, or discontinue any part of the Sites at any time, and we may restrict access for anyone who violates these Terms.

04Calls, Assessments & Applications

Booking a Call

Booking a call with RAW does not create a coaching, clinical, or other professional relationship and does not commit you or RAW to working together. Please give us notice if you need to cancel or reschedule.

Applying to The Fortitude Program™

Submitting an application does not guarantee acceptance or a place in a program. We review every application and may defer or decline an enrollment when, in our professional judgment, the program is not the right fit for someone’s current situation.

Accurate Information

You agree that the information you give us in a booking form, assessment, or application is accurate and is yours to share. How we handle that information is explained in our Website Privacy Policy.

05Programs & Enrollment

Program descriptions on the Sites are summaries. Fees, payment options, refund terms, schedules, and the full terms of participation are provided at enrollment and in the Member Portal Terms & Conditions. Nothing on the Sites is an offer to enroll you until your enrollment is confirmed in writing.

We make reasonable efforts to keep program information on the Sites current, but details may change. If information on the Sites conflicts with your enrollment materials, your enrollment materials control.

06Intellectual Property

All content on the Sites, including text, articles, frameworks, glossaries, assessments, graphics, photographs, videos, logos, and program names (including The Fortitude Program™), is the property of RAW Recovery LLC or its licensors. All rights are reserved. The Fortitude Program™ name is a trademark of RAW Recovery LLC and may not be used without written permission.

You may view and share links to the Sites and print pages for your own personal use. Without RAW’s prior written consent, you may not:

• Copy, republish, or redistribute content from the Sites;
• Use RAW’s content, frameworks, or methods to build competing products, services, or training programs;
• Adapt or create derivative works from RAW’s content or frameworks;
• Use RAW’s content in any public presentation, training, publication, or media; or
• Remove or alter any copyright, trademark, or other notice.

07Third-Party Platforms & Links

The Sites use third-party platforms to take bookings, applications, and assessments, and link to other websites. Your use of them is also subject to their own terms and privacy policies, which RAW does not control.

RAW is not responsible for the content, availability, or practices of third-party websites or platforms, or for outages or problems they cause.

08Testimonials & Site Content

Testimonials, stories, and examples on the Sites reflect individual experiences. They are not a promise that you will get similar results. Where a story has been changed to protect someone’s privacy, the change does not alter what the story is meant to show.

We work to keep the Sites accurate and current, but content may contain errors or become outdated. We may correct or update content at any time without notice.

09Limitation of Liability

Disclaimer of Warranties

THE SITES AND ALL CONTENT, ASSESSMENTS, AND MATERIALS PROVIDED THROUGH THEM ARE OFFERED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. RAW RECOVERY LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RAW DOES NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RAW RECOVERY LLC AND ITS MEMBERS, MANAGERS, COACHES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR EMOTIONAL DISTRESS, EVEN IF RAW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. RAW’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THESE TERMS OR THE SITES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain warranties or liabilities to be excluded or limited. In those places, these limits apply to the fullest extent the law allows.

Indemnification

You agree to indemnify, defend, and hold harmless RAW Recovery LLC and its members, managers, coaches, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Sites, your breach of these Terms, or your violation of any law or anyone else’s rights.

10Dispute Resolution

Informal Resolution First

Before starting any formal proceeding, you and RAW agree to try in good faith to resolve the dispute informally. Email melissa@emotionalfortitude.com or thomas@emotionalfortitude.com describing the dispute in reasonable detail. RAW will respond within fifteen (15) business days. If the dispute is not resolved within thirty (30) days of your first notice, either party may proceed to binding arbitration.

Binding Arbitration

Any dispute arising out of or relating to these Terms or the Sites that is not resolved informally will be settled by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will take place in Orange County, California, unless both parties agree to another location or to remote proceedings. The arbitrator’s decision is final and may be entered as a judgment in any court of competent jurisdiction. Information about JAMS is available at jamsadr.com.

Class Action Waiver

You and RAW each waive the right to bring or join any class, collective, or representative action. All disputes must be brought individually. If this waiver is found unenforceable in a particular case, that case will be heard in court rather than arbitration, and the rest of these Terms will remain in effect.

Exceptions

Either party may ask a court for emergency or preliminary injunctive relief to prevent irreparable harm, including in cases involving unauthorized use of intellectual property. Either party may also bring a qualifying claim in small claims court.

Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. For any dispute not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Orange County, California.

11General Provisions & Contact

Entire Agreement

These Terms, together with our Website Privacy Policy, are the entire agreement between you and RAW Recovery LLC about your use of the Sites. If you enroll in a RAW program, the Member Portal Terms & Conditions and your program agreement also apply.

Severability

If any part of these Terms is found invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest will remain in full effect.

No Waiver

If RAW does not enforce a right or provision in one instance, that is not a waiver of it. A waiver is effective only in writing from an authorized representative of RAW.

Assignment

You may not assign or transfer your rights or obligations under these Terms without RAW’s written consent. RAW may assign these Terms in connection with a merger, acquisition, or sale of assets.
